There are many benefits to using a qualified intellectual property attorney, some of which are addressed below.

An intellectual property attorney:

  • Has a law degree and has passed a state bar
  • Can handle litigation, lawsuits, infringement matters, etc.
  • Can handle patent, trademark and copyright issues
  • Can draft license agreements and contracts
  • Has more specialized knowledge regarding case law

 In contrast, a patent agent:

  • Is a non-attorney with a technical background
  • Can only assist an inventor in obtaining a patent, and that is the extent of their authority
  • Cannot advise on trademark, copyright, licensing, litigation, or contract matters

There is a misconception that using a qualified intellectual property attorney will cost more than an agent or online services.  A sole practitioner, such as myself, can often charge less for their services because of lower overhead expenses.

A sole practitioner has often had law firm experience and extensive legal training. In contrast,  novice independent agents may have little or no practical experience or training and online services may be staffed by non-attorneys.
